Pre-order Terms and Conditions

By submitting your pre-order, the below terms shall govern the placing of a pre-order to any of KikFin’s products (“Pre-order”).

1.Product Description:

KikFin’s pre-order products are described on our website, including their features, specifications, and other relevant details.

2.Reservation:

Pre-ordering KikFin products requires you to provide certain information, such as your address and other billing information. It is your responsibility to ensure that all such information is accurate and up-to-date.

KikFin shall have no responsibility or liability for inaccurate information or information that later becomes outdated, and shall have no obligation to make efforts to determine the correct contact or shipping information.

3.KikFin's Right to Delay or Decline:

KikFin may delay or decline reservations to avoid oversubscription or for other reasons. KikFin will make efforts to inform you within one (1) week of our receipt of your Pre-Order. In the event your Pre-Order has been declined, you will be entitled to a full refund of the purchase price.

4.Price & Payment:

For the First 1,000 units of KikFin , including Fly and Pro versions and/or other bundells or products in the website , you will be charged 30% of the cart price at the time of placing the Pre-Order, and the remaining 70% shall be paid within seven (7) days of KikFin’s notice that your product is ready for delivery.

The purchase price does not include import duties, taxes, transfer fees, and other governmental charges, which are the customer's payment responsibility.

5.Priority:

KikFin shall supply the pre-ordered products according to the order in which the Pre-order is received. This position does not imply receiving a particular number associated with the Pre-order products. If you cancel or forfeit your reservation in accordance with these terms, your position will be taken by the next person on the reservation list.

If the reservation is paid by the customer in a full price cart price and not a 30% deposit, they will gain priority in delivery time.

6.Delivery Schedule:

Although we will make efforts to begin delivering products as soon as reasonably practicable, you understand and agree that there may be delays. An estimated time of delivery is Q2 OF 2024. This estimate is only a forecast and is subject to change, and KikFin does not represent or warrant that it will be able to ship the product by the estimated date.

As a result, in the event that a delay arises and the estimated shipment is not met, KikFin is not responsible for any damages that may occur due to the delay, nor shall it be obligated, except as set forth in these terms, to provide any discounts, refunds, or credits due to any such delays. We will provide you with updates with respect to such a delivery schedule. If for any reason you decide that you do not wish to continue to wait for your product, you may cancel your reservation as provided for in Section ‎5 below.

7.Cancellation:

Either you or KikFin may cancel this reservation by terminating the Pre-order at any time for any reason prior to KikFin’s notice that your product is ready for delivery. In such an event, you will be entitled to a full refund of the purchase price paid by you without interest.

The refund shall be made within up to 14 days of the processing of such request by KikFin. In the event of more than one Pre-order made and canceled by you, KikFin shall be entitled to deduct any processing and/or clearing fees with respect to such amount.

8.Intellectual Property:

KikFin retains all intellectual property rights associated with the pre-ordered products, including but not limited to design, patents, and trademarks. Customers are granted a limited right to use the products in accordance with these terms.

9.Force Majeure:

KikFin shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, or supply chain disruptions.

10.Governing Law and Dispute Resolution:

These terms and conditions are governed by the laws of Israel. Any disputes arising under or in connection with these terms shall be resolved through arbitration by the Tel Aviv Arbitration Institute of the Israel Chamber of Commerce. Both parties agree to submit to the exclusive jurisdiction of the courts located in Tel Aviv.

11.Severability:

If any part of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12.Entire Agreement:

These terms and conditions constitute the entire agreement between you and KikFin regarding the pre-order of products, superseding any prior agreements or understandings.

By submitting your pre-order, you acknowledge and agree to the above terms and conditions.

KikFin reserves the right to change any of the terms for any or no reason. We will provide notice of any material changes. If you are unhappy with such changes, your sole and exclusive remedy will be to cancel your reservation in accordance with Section 7 above.
